1. Parties and publisher
Golf Delta Bravo Aviation, an Arizona limited liability company. Business mailing address: 14555 N Scottsdale Rd., Suite 330, Scottsdale, Arizona 85254. Email: [email protected]. Telephone: +1 (510) 738-4192. These terms concern SITREP: Aviation Briefing and its associated software and Company-provided features (Application). Company and its members, managers, officers, employees, contractors and agents are Protected Parties where expressly stated. The Application is operated by the Company. The current Apple developer account lists Gabriel David Breakstone as the individual publisher pending conversion to an organization account. References to Company do not misstate that Apple publisher record or exclude duties imposed on the actual distributor. These terms supplement applicable Apple beta terms; mandatory Apple terms and nonwaivable law control.
2. Agreement and eligibility
When validly offered with conspicuous access to the complete terms, this Agreement becomes effective through your affirmative acceptance or another legally sufficient agreement process. Merely viewing these terms or sending a support email does not itself establish acceptance. Do not use a purported signature/IP record as proof of acceptance that did not occur. You must have legal capacity and any organizational authority you claim. Invited beta participation is intended for adults. If you do not accept this Agreement, do not use the licensed Application and follow applicable cancellation/refund rights.
3. Limited license
Subject to this Agreement and Apple Usage Rules, the Company grants a limited, nonexclusive, nontransferable license to use the Application on Apple-branded products you own or control for authorized reference purposes. Apple-permitted Family Sharing and volume-purchase access remain available where applicable; this Agreement does not override Apple Usage Rules. Software and Company intellectual property are licensed, not sold. Rights not expressly granted are reserved.
4. Permitted information use
Use information only within the applicable feature scope and source rights. You may retain or share a generated document only to the extent permitted by the rights in its contents and any applicable beta confidentiality obligations. This license does not confer a license to third-party databases, trademarks, diagrams or broadcasts beyond the authorized display/use. Company branding must not be removed in a way that misrepresents authorship or source.
5. Restrictions
Except as expressly permitted by law, do not reverse engineer, decompile or defeat technical protections; resell, sublicense or publicly redistribute the Application; scrape or systematically extract data; circumvent access controls; interfere with service; introduce malware; impersonate another person; or use the Application unlawfully or to infringe rights. Restrictions do not prohibit legally protected interoperability, accessibility, security reporting, consumer complaints, regulatory cooperation or other nonwaivable activities. Do not probe third-party services without their authorization.
6. Reference only; no safety-critical reliance
SITREP does not, at this time, satisfy the complete preflight requirements of 14 CFR § 91.103 and must not be relied upon as doing so. It is a supplemental reference and situational-awareness tool, not a complete preflight briefing, dispatch release, ATC clearance, flight instrument or navigation system. SITREP has not been approved, certified or endorsed by the FAA. Displaying government-issued products does not confer that status on the app, website, summaries or exported reports. Opening SITREP, generating or saving a PDF, acknowledging a notice, using Apple sign-in or viewing source timestamps does not establish regulatory compliance, file a flight plan or create a Flight Service briefing record. A SITREP export is a compiled snapshot only. Local history and export timestamps do not prove that a complete briefing was obtained, read or retained by a recognized briefing service. Do not use the Application for navigation, primary or sole operational reliance, emergency response or safety-critical control.
7. Aviation responsibilities
Before flight, the pilot in command and operator must independently obtain and evaluate all information required for the actual operation, including current weather, NOTAMs and restrictions, alternatives, known ATC delays, fuel, runway lengths and aircraft-specific takeoff and landing performance. SITREP does not provide or verify all of those elements. Use appropriate current authoritative sources and consult Flight Service when needed. The FAA recognizes that a thorough self-briefing may comply with applicable rules; this notice does not assert that a particular provider, logged record or FAA approval of an app is universally required by § 91.103. SITREP retrieves METARs, TAFs, pilot reports and supported weather advisories from NOAA/NWS Aviation Weather Center; traffic-management notices from FAA Air Traffic Control System Command Center (ATCSCC); and airport, runway, communications and facility reference information from published FAA aeronautical datasets, including NASR. Available airport diagrams originate from FAA AeroNav. Radar imagery uses NOAA/NWS radar services over an Apple Maps base map. These are identifiable source products, not weather invented by SITREP. Availability, geographic coverage, issue times, validity periods and dataset effective dates differ by product. D-ATIS is relayed through a third-party feed where available; it is not a direct FAA briefing service or an assurance that the broadcast is current. Manually typed ATIS, imported routes and personal notes are user-supplied. Plain-language decoding, local-time conversions, narratives, wind calculations, comparisons and change cues are SITREP-derived aids. They can contain errors or omit context and are not independently issued or approved by FAA or NOAA/NWS. Original source text, valid periods and applicable operational instructions control.
The pilot in command, operator and responsible personnel retain their duties under applicable aviation rules, including required preflight review. Independently verify current source weather, NOTAMs, restrictions, charts, aircraft/crew qualifications, fuel, performance, runway conditions and ATC instructions. Do not act on an unverified summary, color, clock, calculated wind component, cached chart or missing warning. Nothing in this Agreement excuses the Company from a duty that cannot legally be excluded.
8. Interpretation and inherent information limits
Inputs may be incomplete, incorrectly entered, delayed, transformed, mismatched or unavailable. Summaries, predictions, decoded text, translations and visualizations can be wrong or omit exceptions. They do not guarantee future conditions, identify every hazard or determine approach minima, a qualified alternate, an active runway or a diversion decision. A traffic-management program does not determine whether your particular flight is affected. Device clocks, geography, airport identifiers and true/magnetic references require verification.
9. Offline, alerts and unconnected functions
Offline copies are historical and can expire. An enabled preference is not a guarantee of delivery. This beta has no always-on background push, comprehensive automatic NOTAM aggregation, monitored EDCT retrieval or server-enforced device limits. Networks and source providers can throttle or stop responses. No completeness, continuous availability, recovery service or specific notification timing is promised.
10. Accounts, device security and user entries
Use your own authorized Apple identity and protect your device/account. You are responsible for accurate voluntary entries and authorized sharing, not for events outside responsibilities lawfully assigned to you. Certificate details are not verified by SITREP. Do not enter third-party confidential data without authority. You retain ownership of your original notes and imported content, subject to source rights. You grant only the rights reasonably necessary to store, process, display, synchronize and export them for the functions you request.
11. Privacy and cloud data
The Privacy policy describes actual handling and choices; this Agreement does not replace required consent or legal protections. Optional cloud sync uses the private database in your system iCloud account, which can differ from your Apple sign-in identity. Certificate number is excluded. Disabling sync, signing out or removing local data does not erase every cloud, backup, exported or recipient copy. The Company does not claim it can centrally inspect or delete all private iCloud data. See Storage & deletion before removing information.
12. Third-party services
External services are independently operated and may change or cease. Their valid terms and source rights apply, including carrier and Apple service terms. No government, airline, airport, aircraft manufacturer or data-provider endorsement is implied. The Company does not warrant external content or assume obligations belonging to a third party. This section does not remove Company liability for its own conduct where exclusion is prohibited.
13. Beta confidentiality and feedback
A private beta invitation may identify nonpublic builds, unreleased features, screenshots, recordings and internal briefing examples as confidential. Use reasonable care and do not disclose those nonpublic materials outside the authorized cohort without permission, except where disclosure is legally protected or required. This is not a prohibition on honest reviews, complaints, legal advice, legal process, reporting safety/security concerns to appropriate authorities or disclosures protected by law. Information independently developed, already lawfully known or public without breach is not confidential. Feedback may be used to improve the product without compensation or an obligation to implement it; you retain rights in unrelated personal content.
14. Round 1 access promise
The founder has offered initial Round 1 participants lifetime SITREP Pro access. If you are confirmed as a participant covered by that promise, ordinary later pricing changes do not revoke it. The Company will document eligibility and scope with the participant rather than treat a local mail-app handoff as a verified entitlement. Lifetime access concerns the availability of SITREP Pro while the Company offers that product; it does not promise perpetual corporate existence, permanent third-party data rights or unrelated future products. Do not apply a narrower definition retroactively without a lawful agreement. Consumer rights and specific written commitments control over inconsistent general beta language.
15. Fees and future subscriptions
No billing is active in the current beta. A price preview is not authorization to charge. Any future purchase requires separate clear price, term, renewal and cancellation disclosures and the applicable Apple purchase flow. You may manage Apple subscriptions through Apple settings. Refund rights follow applicable law and Apple processes. This Agreement does not authorize automatic conversion from free beta to paid access or override the Round 1 commitment.
16. Updates, suspension and termination
The Company may modify features and suspend or terminate a license for material breach, security risk, loss of source rights, legal necessity or discontinuation, subject to applicable notice, cure, refund and consumer obligations. Changes do not retroactively erase accrued rights or specific access commitments. You may stop using the Application. On lawful termination, cease licensed use and remove the Application, subject to legal retention requirements and copies you may lawfully retain. Confidentiality, ownership, lawful liability limits and dispute terms survive only as appropriate to their nature.
17. Maintenance and support
The Company provides any support it expressly undertakes and any support required by law. Support is not an emergency, aviation dispatch or guaranteed-response service. Beta response targets are goals, not a guaranteed resolution. Apple has no maintenance/support obligation for the Application. Contact the Company using the business details in section 1 and the in-app Support function.
18. Warranty disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION AND COMPANY-PROVIDED CONTENT ARE PROVIDED AS IS AND AS AVAILABLE, WITH ALL FAULTS. THE COMPANY DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE. NO GUARANTEE IS MADE OF ACCURACY, COMPLETENESS, TIMELINESS, UNINTERRUPTED OR ERROR-FREE OPERATION, CORRECTION OF EVERY DEFECT, OR PRESERVATION/RECOVERY OF DATA. Oral advice does not create a warranty unless legally binding. This section does not disclaim an express promise that law protects or a warranty that cannot legally be disclaimed.
19. Exclusion of categories of damages
SUBJECT TO SECTION 21 AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROTECTED PARTIES ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, BUSINESS OPPORTUNITY, GOODWILL OR DATA, ARISING FROM THE APPLICATION OR ITS UNAVAILABILITY, EVEN IF ADVISED OF THE POSSIBILITY. This allocation applies only where legally enforceable, regardless of the asserted theory, and does not recharacterize legally recoverable direct damages or nullify a mandatory remedy.
20. Aggregate liability cap
SUBJECT TO SECTION 21 AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF THE PROTECTED PARTIES FOR CLAIMS ARISING OUT OF OR RELATING TO THE APPLICATION OR THIS AGREEMENT WILL NOT EXCEED THE GREATER OF US $100 OR THE AMOUNT YOU PAID THE COMPANY FOR THE APPLICATION IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. This is a contractual risk allocation, not a statement that a court will uphold it in every circumstance. Apply the maximum lawful remedy instead if a mandatory rule prevents the cap.
21. Mandatory exceptions and consumer rights
NOTHING IN THIS AGREEMENT EXCLUDES OR LIMITS LIABILITY FOR FRAUD, FRAUDULENT MISREPRESENTATION, WILLFUL MISCONDUCT, GROSS NEGLIGENCE, WILLFUL INJURY, VIOLATIONS OF LAW WHERE LIMITATION IS PROHIBITED, DEATH OR PERSONAL INJURY WHERE LIABILITY CANNOT LAWFULLY BE LIMITED, OR ANY OTHER NONWAIVABLE DUTY, RIGHT OR REMEDY. California Civil Code section 1668 and applicable consumer/public-policy rules control where they apply. No California Consumers Legal Remedies Act right, mandatory privacy remedy, legally protected public-injunctive relief or regulatory complaint is waived. No blanket release of unknown claims is requested. Aviation-related public-interest duties may also affect enforceability.
22. Limited third-party-claim indemnity
To the extent lawful, you will defend and indemnify the Protected Parties against third-party claims and reasonable resulting costs to the extent caused by your unlawful conduct, knowing infringement or material breach of the restrictions in this Agreement. No indemnity is required for a Protected Party's own fault, breach, fraud, gross negligence, willful misconduct or violation of law, or for asserting your own good-faith consumer/privacy rights. The Company must give reasonable notice, cooperate at its expense and permit an appropriate defense; no settlement may admit fault, impose nonmonetary duties on you or prejudice protected rights without consent. Comparative responsibility and mandatory consumer law apply.
23. Company personnel and separate capacity
The license is intended to be granted by the Company, not a personal warranty or guarantee by a founder, member, manager, employee or contractor. Protected Parties may enforce the lawful protective provisions expressly intended for their benefit. This does not create immunity, alter the identity shown in Apple's distribution records, avoid a lawful personal duty or prevent liability that attaches under applicable law. Conversion of the Apple developer account to an organization account does not retroactively change responsibilities imposed by law.
24. Governing law and courts
Arizona law governs to the extent lawful, excluding conflict-of-laws rules, and federal law applies where controlling. Subject to mandatory consumer jurisdiction and small-claims rights, the parties submit to state courts in Maricopa County, Arizona, or federal courts with jurisdiction there. This selection does not deprive a consumer of nonwaivable protections or access to a required home forum. This Agreement contains no mandatory arbitration clause, class-action waiver, jury-trial waiver or unilateral shortened limitations period.
25. Informal resolution and protected reporting
You may contact [email protected] to describe a dispute and desired resolution. The parties may seek a practical resolution in good faith, but correspondence is not a mandatory barrier to court, an emergency remedy or a statutory filing deadline. You may contact regulators, seek public-injunctive relief where protected and consult counsel. No provision imposes confidentiality on a legally protected report or demands withdrawal of a good-faith complaint.
26. Apple-specific allocation
This Agreement is between you and the Company, not Apple. The Company handles Application-related product, regulatory and consumer claims and third-party intellectual-property claims. If an applicable warranty is not effectively disclaimed and the Application fails it, you may notify Apple for refund of the purchase price; Apple has no further warranty obligation to the extent law permits, and the Company handles remaining responsibility. Apple and its subsidiaries are beneficiaries entitled to enforce applicable terms after acceptance. Apple Usage Rules govern permitted Apple-device, Family Sharing and volume-purchase access.
27. Export, legal compliance and assignment
You represent that you are not in a U.S.-embargoed or designated terrorist-supporting country and are not on an applicable U.S. prohibited/restricted-party list. Comply with export and sanctions law. You may not transfer the license except as law and Apple Usage Rules permit. The Company may transfer its rights/obligations with a lawful business transfer subject to existing commitments, privacy obligations and mandatory notice/consent. This clause does not transfer a third-party license the Company cannot lawfully assign.
28. Complete terms, changes and severability
This Agreement and expressly incorporated documents constitute the applicable license terms, without overriding mandatory law, Apple terms or specific surviving written commitments. Material changes require legally sufficient notice and renewed assent where necessary; no retroactive waiver arises from silent updates. If a provision is unlawful, sever it only to the extent permitted without rewriting a fundamentally unfair bargain. Failure to enforce is not a waiver. Headings aid reading. Contact information in section 1 is the address for questions, complaints and claims. No relationship of agency, partnership or fiduciary duty is created solely by app use.
